Last week, Judge Beryl Howell, the chief judge of the D.C. district court, ordered Evan Corcoran, a former attorney for Donald Trump, to provide testimony on topics he previously refused to discuss before a federal grand jury. The investigation centers around classified documents found at Mar-a-Lago. In addition to testimony, Corcoran has been ordered to turn over evidence such as handwritten notes, invoices, and transcriptions of personal audio recordings. The order was issued after the special counsel team, led by Jack Smith, uncovered evidence suggesting that Trump may have misled Corcoran into using his services to further a crime. As a result, prosecutors are able to use the crime-fraud exception, which permits the piercing of attorney-client privilege to access information relevant to the investigation.
CBS News reports that Corcoran is scheduled to testify before the grand jury on Friday, and there is no indication that Trump’s team will appeal to the Supreme Court. The speed at which this ruling was made was noted by CNN legal analyst Elie Honig, who described it as a “major ruling, made with astonishing speed.” Former U.S. Attorney Harry Litman concurred, praising the DC Circuit for quickly rejecting Trump’s challenge to the district court order that compels Corcoran to testify and produce documents. Litman also noted the significance of the evidence that could be revealed, including the transcriptions, which he suggested could be “huge.”
